Half Day

The Agency Workers' Regulations will become law by 5th December (1 October elsewhere in the UK). From that date(s) temporary agency workers will be entitled to additional rights once they have been in a job for 12 weeks (although some apply from day one). These rights aim to provide "equal treatment" to the huge numbers of temporary workers in the UK. Employers will need to inspect closely how temporary workers are paid and their entitlements to other contractual benefits or risk severe penalties.

Description

Why attend this event?

Delegates attending this seminar will:

  • Receive a full understanding of the planned regulations in just half a day;
  • Benefit from sessions delivered by a highly experienced employment lawyer;
  • Receive thorough written materials for future reference, including speaker notes and government guidance; and
  • Reinforce learning through a team based ‘workshop’ section of scenarios based on delegates’ questions.

What will I get out of it – what are the learning outcomes?

In the first part of this event delegates will gain an understanding of:

  • How the 12 week qualifying period will operate in practice;
  • How pay and other eligible benefits are defined;
  • Which comparators may be used in an organisation for the purposes of “equal treatment”;
  • The extent to which length of service and qualifications can justify better terms and conditions for permanent staff;
  • The position where a temp is performing a "unique" role;
  • The position regarding overtime and shift allowances
  • How to deal with other collective benefits such as access to canteen facilities, childcare and transport arrangements;
  • The right of temps to be informed of job vacancies with the hirer;
  • The anti-avoidance rules;
  • Where liabilities fall; the agency, the hirer or both? and
  • What penalties apply for employers who get it wrong.
  • What are the likely trends?

After the first half seminar delegates will work through a series of questions, such as:

Q. Which agency workers are covered and who are the exceptions?

Q. How can I avoid liability?

Q. What rules do we need to put in place now?

Q. How much must we pay agency workers?

Q. How can agencies help us now in the run up to implementation?

Q. What does equal treatment cover?

Q. Must I offer premia on overtime and night working?

Q. What is covered by equal pay?

Q. What is meant by the ‘same’ terms and conditions of employment?

Q. Can we break service without incurring liability?

Q. What if my ‘facilities’ can’t cope with agency workers’ demands? Can I give first preference to my own staff?

Q. What are the costs of less favourable treatment?

Q. What information do I have to provide the agency? What processes do I need? Who takes the risk?

Q. What training do my current employees need?

Plus – submit any questions you wish in advance or on the day.
