Dilemma 1: The Remote Revolution and Flexible Working – Balancing Flexibility, Fairness, and Productivity

The shift to remote and flexible working has reshaped Northern Ireland’s workplaces, creating complex HR dilemmas. As hybrid and flexible models become the norm, leaders face challenges around fairness, productivity, and managing competing work arrangements.

This session, led by Ian McFarland, Partner at Eversheds Sutherland, will address key HR and legal issues businesses face in this new landscape, offering practical solutions for navigating both remote and flexible working arrangements. Ian will answer all your dilemmas including:

  • How can you manage complaints from employees unable to work remotely or work flexibly?
  • How do you handle a remote working request for an employee returning from maternity leave that may not align with the requirements of the employee’s role?
  • What about ‘last minute’ working from home requests – how to be fair, without being a pushover?

Dilemma 2: Sick of Sick Days? – Learn what works and what doesn’t with absence management

Managing sickness and absence in the workplace can be particularly complex when employees are dealing with physical, mental health, or neurodivergent conditions. Employers must balance their legal obligations with the need to maintain a fair and productive environment. This session will explore the challenges and legal considerations associated with sickness and absence management for these employees.

Jason Elliott BL answers your dilemmas including:

  • How can employers manage the fine line between supporting employees with health conditions and maintaining fairness for other staff when dealing with sickness and absence?
  • What can organisations do when a sick employee decides not to communicate at all whilst on long-term sick leave? And what if OH reports aren’t the answer?
  • What if an employee is really unwell and it's a family member or partner you're dealing with on their behalf? How can organisations be helpful and sympathetic while staying on the right side of GDPR?

Dilemma 3: Balancing Work and Personal Life

In today’s fast-paced work environment, the line between professional and personal life is often blurred, creating complex challenges for both employers and employees. From workaholic bosses emailing at all hours to social media posts that contradict sick leave claims, managing this balance requires careful consideration of boundaries, expectations, and fairness. This session will explore how HR can effectively address these dilemmas while maintaining a healthy work culture.

Ian McFarland, Partner at Eversheds Sutherland answers your dilemmas on clashes between work and personal life including:

  • How should HR address the issue of a workaholic boss who expects employees to be available after hours, and what impact does this have on employee well-being and productivity?
  • What should an organisation do when personal conduct outside of work, such as a public altercation or inappropriate social media posts, starts affecting the workplace?
  • How should HR handle situations where employees on sick leave are found to be engaging in activities, like skiing or partying, that suggest they are not genuinely unwell?

Dilemma 4: ‘Other’ Leave - Compliance vs. Best Practice

With rapid changes in employment law in GB, and uncertainties surrounding Northern Ireland’s ‘Good Jobs’ Bill, sticking to the status quo might feel like the safest option – but is it? HR faces mounting pressure to navigate changes to family-friendly rights, carer’s leave, and domestic abuse leave. At the same time, HR is tasked with meeting ever-growing business demands.

Led by Jason Elliott BL, this session will offer practical insights into navigating changes and balancing compliance with innovative HR strategies. Key questions we’ll explore include:

  • Is a compliance-only approach to leave enough, or is best practice the way forward?
  • How can HR align employee well-being with business priorities?
  • How can HR prepare for and excel amid legislative changes?
