The Claimant contended that the Respondent, her previous employer, had failed to make a reasonable adjustment for her to attend an interview for a vacancy within the University. The Claimant was disabled by an allergic condition and had been put on garden leave for some time. She applied for a vacancy in 2006 and then again for the same post in 2008. In April 2008 the Claimant attended a competitive interview, but it was cancelled due to an allergic reaction. She was interviewed again later in the month when her allergy was not inflamed.
The interview panel found that she failed to meet two of the essential criteria for the post and she was not offered the job. The Claimant contended that the Respondent had failed to make a reasonable adjustment by requiring her to go through the interview process.
The EAT found that although a University's duty to make a reasonable adjustment was engaged when it required a disabled employee to go through a competitive interview process, that duty had not been breached where the adjustment sought was tantamount to appointing her to a role for which she did not meet the requirements. http://bit.ly/1aB2ATS
