The Importance of Workplace Harassment Training

Northern Irish employers have a legal responsibility to protect staff from harassment and sexual harassment at work

Northern Ireland is becoming an increasingly modern place to live and work. With that, offering workplace harassment training has become more important than ever. Every employee, regardless of their role, position, or personal background, deserves to be treated with dignity and respect in the workplace.

It is essential to promote a zero-tolerance policy against any form of harassment and create a culture where each and every individual feels safe and valued, regardless of their gender identity and gender expression, sexual orientation, age, disability, race, religious beliefs, political values, or anything else.

Harassment of any kind should not be tolerated whether employees work at a fixed location, at home, or on the move. Harassment in all its different forms can be incredibly damaging to an employee’s mental and physical health, negatively impacting workplace culture and productivity.

Northern Irish employers have a legal responsibility to protect staff from harassment and sexual harassment in the work environment. As an employer, you must do everything you reasonably can to protect staff from harassment and take steps to prevent it from happening. 

Employers are liable for employee conduct and harassment committed by workers in the course of their employment unless they can rely on the ‘reasonable steps’ defence.

A tribunal will consider an employer’s reasonableness in terms of how they have acted and the steps they have taken to ensure employee safety and prevent harassment of their workers. This will include examining the human resources available and looking at whether or not the company has offered a training course that outlines expected employee conduct.

Who Needs Workplace Harassment Training?

Organisations should train all staff on their rights and responsibilities regarding harassment

In their ‘Eliminating Sexual Harassment from the Modern Workplace’ guidance, the Labour Relations Agency (LRA) and Irish Congress of Trade Unions (ICTU) advise that organisations should train all staff on their rights and responsibilities regarding harassment.

This includes explaining the kind of behaviour that constitutes harassment and how staff can recognise and address unacceptable behaviour in the work environment through active bystander intervention.

They advise that workplace harassment training be completed as part of a new employee orientation on the start date of employment. It should then be refreshed regularly to ensure that all staff are aware of how to recognise and address unreasonable behaviour.

Carrying out up-to-date training will help staff members avoid the threat of harassment and give witnesses and bystanders the means to intervene or support victims safely.
