Chris has extensive experience dealing with both contentious and non-contentious employment law matters. Chris has represented clients before the Industrial Tribunal, Fair Employment Tribunal and the Court of Appeal in Northern Ireland in employment litigation such as unfair dismissal, equality/discrimination and whistleblowing. What are the rights of employees and workers to receive a payslip?
Currently, under Article 40 of the Employment Rights (Northern Ireland) Order 1996, it is only an employee who has the right to be given a written itemised pay statement from his employer which shall contain particulars such as:
- The gross amount of wages or salary;
- Amounts of any variable and fixed deductions from that gross amount and the purposes for which they are made;
- Net wages or salary; and
- The method of payment of each part-payment if the net amount is paid in different ways
Northern Ireland is in contrast with the rest of GB on this issue as, under the Employment Rights Act 1996 (Itemised Pay Statement) (Amendment) Order 2018, the right to receive an itemised pay statement is extended to all workers and must include the necessary information including setting out the number of hours that have been paid regarding when pay varies depending on time worked.
