Today's email covers two issues.

The first case is in relation to an unfair dismissal claim against Castlereagh Borough Council at which the Claimant was unsuccessful on the grounds that the Claimant was given a final written warning for major misconduct and thereafter there were further incidents of verbal abuse and the Claimant failed to comply by the absence management procedure and was thereafter dismissed. The Claimant in this case argued that the penalty was too harsh and that she was subject to disability discrimination. However, the Tribunal did not uphold her complaint. Full article:

The second article involves a Claimant who was successful against the Respondent after they continued on a misconceived basis to argue TUPE applied when it clearly did not apply and costs were awarded. The Claimant was awarded £51,281.52 and further costs of £4,000 plus VAT and outlay. Full article:
