What are the relevant updates regarding right to work checks?
There are new right to work checks set to be introduced on the 6 April 2022, which will permit employers to used certified providers to undertake digital identity checks. The current adjusted right to work checks process was due to end on 5 April 2022. However, on 22 February 2022 the Home Office extended the concession permitting employers to carry out a manual right to work check using video conferencing and copies of supporting documents to 30 September 2022. This new online system will come into effect for British and Irish citizens with a valid passport. Employers will have to pay a fee if they wish to avail of this new system. However, employers can continue to carry out manual right to work checks for free if they would prefer.
From 6 April 2022, it will become mandatory for employers to conduct free online right to work checks on those with a biometric residence permit, a biometric residence card or a frontier work permit. Manual right to work checks carried out on or after 6 April 2022 for individuals in these categories will not be valid. These online checks will be carried out using the Home Office’s online RTW check service. The Home Office is expected to issue further guidance on these changes which will be documented in the near future.
